Acceptance of Terms
By accessing orbitronix.tech or using the Orbitronix Growth OS platform (marketing.orbitronix.tech), you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use our website or services.
Services
Orbitronix Technologies provides software engineering, AI consulting, and the Orbitronix Growth OS — a marketing automation platform that integrates with the WhatsApp Business Platform, Facebook, Instagram, and Meta Ads to help businesses manage leads and run Click-to-WhatsApp advertising campaigns. The specific scope, deliverables, timeline, and pricing of any engagement are defined in a separate written agreement.
Acceptable Use — WhatsApp and Meta Platforms
By using any feature that sends WhatsApp messages or interacts with Meta platforms, you agree to: (a) comply with the WhatsApp Business Terms of Service and Meta Platform Terms at all times; (b) only send messages to individuals who have opted in to receive communications from your business; (c) not send spam, unsolicited bulk messages, or messages that violate Meta’s messaging policies; (d) not use the platform to harass, deceive, or harm any person; (e) not circumvent Meta’s rate limits, content policies, or prohibited use restrictions. Violation of these terms will result in immediate account termination.
Ad Campaigns
All advertising campaigns created through the Growth OS platform are submitted in a PAUSED state and require your explicit review and activation. Orbitronix does not activate or modify live campaigns without your approval. You are solely responsible for the content, targeting, and budget of all campaigns run from your Meta Ad Account. You must comply with Meta’s Advertising Policies (facebook.com/policies/ads/) for all ad content.
Data and Privacy
Your use of the platform is governed by our Privacy Policy at orbitronix.tech/privacy. You are responsible for ensuring that any personal data you collect through lead forms, WhatsApp interactions, or ad campaigns has been collected with appropriate consent under applicable data protection laws.
Intellectual Property
All website content, design, and code is the property of Orbitronix Technologies. For client engagements, intellectual property ownership of custom-built deliverables is as specified in the individual engagement agreement. Unless otherwise agreed, clients receive full ownership of custom-built software upon final payment.
Confidentiality
Information shared during project discussions, discovery calls, and active engagements is treated as confidential. We do not share, disclose, or use client information outside the specific engagement. NDAs are available upon request.
Limitation of Liability
Orbitronix Technologies is not liable for: suspension or restriction of your Meta or WhatsApp Business accounts by Meta; losses arising from ad campaign performance; indirect, incidental, or consequential damages beyond the terms specified in your engagement agreement; or service interruptions caused by third-party platform outages (Meta, WhatsApp, Anthropic, Runway).
Termination
We may suspend or terminate your access to the Growth OS platform if you violate these terms, particularly the Acceptable Use provisions. Upon termination, your data remains available for export for 30 days, after which it will be deleted in accordance with our Privacy Policy.
Governing Law
These terms are governed by the laws of Bangladesh. Disputes shall be resolved through good-faith negotiation before any formal legal action. For disputes involving Meta platform services, Meta’s terms and applicable law also apply.
Changes to These Terms
We may update these terms. The current version is always available at orbitronix.tech/terms. Continued use of our services after updates constitutes acceptance.
